2. Prior knowledge
If the recipient of our offer is aware of a property named by us, the recipient is obliged to notify us immediately.
3. Entitlement to commission
Our right to a commission arises as soon as a contract is concluded with respect to real estate designated by us. Causation is sufficient. If the agreement is concluded under different terms to those originally offered or if it comes about through a different property of the contracting party proven by us, this does not affect our claim to commission, if the transaction which came into being is commercially identical to the transaction offered by us or its commercial success differs only negligibly from the offered transaction.
The claim to commission remains valid even if the contract concluded becomes invalid through the validity of a condition subsequent. The same applies, if the contract expires by the practice of a legal or contractual resignation right, for reasons which are within their control or for other reasons within the control of a person of a party. When exercising a right of challenge by our offer recipient (our client) which is not substantiated as being due to a malicious intent to deceive by the other contractual party, a damage claim against the challenging party is to apply instead of our commission claim.
4. Maturity of the commission claim
Our commission claim is due upon certification or upon conclusion of the contract. Multiple customers are jointly liable for the full commission. The commission is due and payable without deduction within 8 days after invoicing. In case of default, default interests in the amount of 3.5 % p.a. above Euribor shall be due.
5. Commission rate
The broker’s commission of 5.95% incl. VAT is payable to our company by the buyer upon purchase and/or sale of house and/or property as well as of part ownership, based on the contractually agreed overall purchase price. For commercial lettings the commission amounts to three net rents plus VAT.
6. Exclusive contract
The terms for exclusive contracts are stipulated in individual contracts.
7. Activity for participants
We are entitled to act for other contractual parties against payment and without limitation.
8. Contract negotiations and conclusion of contract
If due to our proof and/or switching activity direct negotiations with the contracting party are taken up, is to be referred to our activity. We are entitled to take part in the signing of the contract. The date and place shall be announced in due time. Furthermore we have requirement on distribution of a contract copy including any ancillary agreements which refer to them.
9. Completion of the order
If an order placed with us becomes invalid, the client is obligated to inform us of this immediately in writing. Contrary behavoiur of the client entitles us to claim a reimbursement for our material and timing expenses. The compensation for lost time is determined based on the compensation of certified experts.
10. Partial invalidity
If any provision of these terms and conditions is held invalid, the invalidity shall not affect other provisions herein. Statutory provisions shall take the place of any provisions that are ineffective or null and void.

Place of fulfilment and legal domicile is Otterndorf.
